    Notice of Voluntary Mediation Pursuant to North Carolina General Statutes, Section 7A-38.3F,

    The association is required to notify its members each year of their right to request voluntary

    mediation of any dispute with the association arising under the North Carolina Planned Community

    Act, the North Carolina Condominium Act, or under the association’s declaration, bylaws, or rules

    and regulations. The association shall publish the notice on the website. Either party can decline to

    engage in mediation for any reason. Disputes related solely to a member’s failure to timely pay an

    association assessment, or any fines or fees associated with the levying or collections of an association

    assessment are not covered by the mediation statute. The procedure for requesting mediation is set

    forth in the statute.
